NexGen Staging Limited

Terms & Conditions of Sale

Incorporating the Company Privacy Policy

1. Introduction & Definitions

  • “The Company” refers to NexGen Staging Limited (NSL).

  • “The Customer” refers to the person, firm, or company placing an order or receiving a quotation.

  • “The Goods” refers to any products supplied under quotation or order.

All quotations, orders, and contracts are governed by these Conditions of Sale unless a special written arrangement is signed by a Company Director.

No agent or salesperson may vary these terms or offer guarantees beyond what is written here.

2. Formation of Contract

A binding contract exists only when the Company accepts an order. All prior correspondence is superseded. Contracts are deemed made at the Company’s registered office. Prices may be revised for errors or omissions within two months of delivery.

3. Technical Data & Specifications

Drawings, descriptions, adverts, and price lists are approximate and not contractual. The Company accepts no responsibility for:

  • Site suitability

  • Foundations

  • Fitting within customer dimensions

  • Compliance with local regulations

  • Special requirements the Customer must fulfil

4. Title & Ownership

Section 12 of the Sale of Goods Act 1979 applies. Ownership passes only when full payment (including interest) is received.

Until then:

  • Goods must be stored separately and clearly identified as Company property.

  • Customer acts as fiduciary agent and bailee.

  • Customer may resell goods but must account for proceeds.

  • Company may repossess goods if payment is not made.

5. Pricing

  1. Prices are those ruling at despatch unless a valid quotation exists.

  2. Quotations are honoured only within their stated time limits.

  3. Prices exclude VAT and special packing.

  4. Customer‑requested changes may incur additional costs.

  5. Payment must be made without deduction or set‑off.

6. Variations to Specification

The Company may substitute equivalent materials or components if originals are unavailable.

7. Delivery

  • Delivery dates are estimates only; the Company is not liable for delays.

  • Risk passes to the Customer upon arrival of the delivery vehicle.

  • Customer is responsible for unloading and must provide labour and lifting equipment.

  • Goods may be delivered in instalments.

  • Delays caused by the Customer may incur storage or additional costs.

8. Transit & Delivery Defects

  • Damage must be reported within 48 hours unless proven impossible.

  • For third‑party carriers, the Customer must follow carrier claim procedures.

  • Liability is limited to repair, replacement, or discount — never exceeding invoice value.

  • No consequential loss is covered.

9. Payment Terms

  • Payment is due at the Company’s office unless otherwise agreed.

  • Non‑credit customers must pay in full before despatch.

  • Credit customers must pay on the invoice date; late payments incur interest under the Late Payment of Commercial Debts Act 1998.

  • Credit limits must not be exceeded without written approval.

  • Card payments may be used, including repeat or subscription payments (see CPA section).

10. Risk & Passing of Property

Risk passes on delivery. Customer must insure goods until full payment is made. Company retains ownership until all sums are paid.

11. Suspension or Cancellation

The Company may suspend or terminate deliveries if:

  • Payment is late

  • Customer breaches contract

  • Customer enters insolvency or ceases trading

Customer indemnifies the Company for losses arising from cancellation.

12. Guarantee & Usage Disclaimer

Warranty & Usage Expectations

10‑Year Usage Expectation NexGen Staging systems are designed to provide a long working life — typically 10 years or more — when used correctly and maintained in line with the guidance provided. The staging will continue to operate as intended only when all riser‑leg components required for normal operation are replaced promptly if they become bent, worn, or damaged during use.

12‑Month Materials & Workmanship Guarantee All platforms and components are covered by a 12‑month guarantee against defects in materials or workmanship. This guarantee applies only to manufacturing issues and does not cover normal wear and tear, accidental damage, misuse, or deterioration caused by incorrect storage or handling.

Essential Maintenance Requirements

To ensure the system continues to function safely and correctly throughout its lifespan:

  • The staging must be used on flat, level, dry surfaces.

  • Any riser‑leg parts that become bent, cracked, or damaged must be replaced immediately.

  • Failure to replace damaged parts can cause the system to become unstable or dysfunctional.

  • Continuing to use the system with damaged components invalidates both the usage expectation and the guarantee.

Our Parts Centre stocks every individual component required to keep your staging operating at 100%. Replacement is straightforward, and we provide step‑by‑step video guides on our website to assist with safe and correct part swapping.

Important Warranty Limitation

The warranty and long‑term usage expectation rely on the customer:

  • Following all assembly and usage instructions

  • Performing routine checks

  • Replacing worn or damaged parts promptly

  • Storing the product correctly (dry, stable temperatures, protected from moisture)

If damaged parts are not replaced, or if the staging is used outside the conditions described, the system may not perform correctly and the warranty/guarantee will no longer apply.

Guarantee is void if:

  • Goods are unpaid

  • Customer attempts unauthorised repairs

  • Customer fails to follow instructions

  • Defects are not reported within one month of discovery

Safety Disclaimer

“NEXGEN STAGING LIMITED accepts NO Claims made through injury sustained whilst using its raised products. USERS MUST form and publish their own RISK ASSESSMENT… USING THE PRODUCTS… IS TOTALLY AT THE USERS OWN RISK.”

Products must be used on flat, level, dry surfaces and stored appropriately.

Craftsmanship Note

Minor cosmetic variations may occur due to hand‑built manufacturing and transit. These do not affect performance.

13. Order Variation & Returns

  • Returns accepted if goods are brand new and unused.

Except for death or personal injury caused by negligence:

  • All warranties (express or implied) are excluded.

  • No consequential loss is covered.

  • Specially manufactured goods are not warranted fit for any particular purpose.

  • For non‑Company goods, liability is limited to manufacturer warranties.

15. Lien

The Company may retain goods until all sums are paid and may sell them after 14 days’ notice.
